Applicants can apply for an EAD by filing immigration form I-765 (Application for Employment Authorization) with the U.S. Citizenship and Immigration Services (USCIS). Foreign nationals who are in the US for a limited term and are eligible for employment with no restrictions can file Form I-765 (http://www.uscitizenship.info/us-visas/i-765-employment-authorization.jsp) . Those who are non-US citizens, authorized to work in the US, and who may need documentation to prove their work eligibility can also file Form I-765.

Non-immigrant visa holders who have been authorized to work for a particular employer should not file this form, however. US citizens, conditional permanent residents, and permanent residents do not need to file Form I-765, either – their status is proof of employment eligibility.
